KEFEVİ’YE GÖRE HANEFİ MEZHEBİNİN TEŞEKKÜLÜ

Öz
Mahmut b. Süleyman el-Kefevî, “el-Ketâib” adlı eserinin, Ebû Yusuf’la (ö. 182/798) başlatıp es-
Saymerî (ö. 436/1044-45) ile bitirdiği yaklaşık üç asırlık dönemi kapsayan ilk altı ketîbesini, mü-
tekaddimin dönemine, diğer bir ifade ile mezhebin teşekkül dönemi fukahasına ayırır.
Tebliğimizde bu dönemi, “kişiler”, “eserler” ve “iktibaslar” olmak üzere üç ana başlık altında
inceleyeceğiz. Böylece:
Mezhebin hangi ilmî havzalarda, hangi zaman diliminde kimler kanalıyla yayıldığını
isitatistikî bilgiler, haritalar ve tablolar halinde sunmaya,
Bu zaman zarfında oluşturulan mezhep literatürü ile nasıl bir “mezhep bilgi sistemi”
teşkil edildiği hususunu tablolar halinde göstermeye,
Bir de iktibas zengini bir eser olan “el-Ketâib”deki iktibasların hangi gerekçelerle ya-
pıldığını örnekler üzerinden takdim etmeye çalışacağız.

The Formation of Hanafi School according to Kefevi
Absract
Mahmud b. Suleyman el-Kefevi reserves first six ketibe of his magnum opus el-Kataib, to the
jurists (fuqaha) of muteqaddimun or formation period of Hanafi school which covers approxima-
tely three centuries. The biography of Abu Yusuf (d. 182/798) is the first biography of the section
and it ends with el-Saymeri’s (d. 436/1044-5).
In this paper we study this period under three headings: People, Books, Quotations.
We will present,
the spread of the Hanafi school with statistical information, maps and tables emphasising
on scholarly environments, time periods and key personalities,
the formation of information system of the school on the bases of scholarly literature
produced by Hanafi jurists,
the reason of quotation employed by the author in his frequent quotations in el-Kataib.

MAHMUD B. SÜLEYMAN KEFEVİ’NİN KETÂİB’İ
IŞIĞINDA ŞERİAT FİKRİ

Öz
Allah (c.c.) ilk insan olarak yarattığı Âdem’i (a.s.) aynı zamanda şeriatın ve hukukun da ilk uy-
gulayıcısı kılmıştır. İlerleyen süreçte insanlığın huzurunu ve düzenini temin edecek olan hu-
kuki/şer’i düzenlemeleri peygamberleri vasıtasıyla insanlığa kademe kademe ulaştırmıştır. Al-
lah’ın insanlara Emirler ve yasaklar göndermesi fikrinin kurumsal yapısı şeriat olarak adlandırıl-
maktadır. Bazı peygamberlere kitap veya sahife şeklinde verilen ilahi mesajaların tümü inanç
esasları yanında bir de davranış kuralları içermekteydi. Kefevi Ketâib adlı çalışmasında Hanefi
mezhebinin fıkıh tarihini yazarken İslam şeriatının kendisine dayandığı peygamberler halkasını
Şeriat sahibi peygamberler öne çıkararak kaleme almıştır. Ardından son peygamber Hz Muham-
med’e indirilen Şeriatı ve bu şeriat fikrinin müçtehid imamlar dönemine kadar nasıl geldiğini
göstermek üzere bazı bölümler eklemiştir. Bu çalışmada biz Kefevi’nin şeriat fikrini sunuş biçi-
mini seçtiği peygamberlerle ilgili bölümde inceleyeceğiz. Ardından son şeriat ile önceki şeriatları
birbirlerine nasıl bağladığına bakacağız. Ayrıca Peygamberimizle Ebu Hanife arasındaki ilmi
halkayı nasıl kurduğunu tahlil edeceğiz.

The Idea of Shari'a in the Katāʾib of Mahmûd b. Süleymân Kefevî
Absract
When Allah (jalla jalaluhu) created Adam (pbuh) as the first human being, He also made him the
first practitioner of the shari'a and the law. Throughout history, Allah (jalla jalaluhu) gradually
sent new legal regulations and laws through His prophets and messengers in an aim to bring peace
and order to humanity. Shari'a is the name of the institutional structure of the idea that Allah (jalla
jalaluhu) reveals His orders and prohibitions. All of the revealed divine messages to prophets in
the forms of kitab (book) or suhuf (pages) contain both a set of beliefs and codes of conduct. In
his Katāʾib aʿlām al-akhyār min fuqahā madhhab al-Nuʿmān al-mukhtār, the Ottoman scholar
Mahmûd b. Süleymân Kefevî (d. 1582) produced an account of a legal history of the Hanafi ju-
risprudence. In the part when he wrote about the prophets that the Islamic law depends itself on,
he made an emphasis on the prophets with shari'a. To his work, Kefevî also added chapters de-
picting the shari'a that Allah (jalla jalaluhu) revealed to His last Prophet Muhammad (pbuh) and
how the idea of shari'a reached to the era of the mujtahid imams. This paper will be an analysis
of the part of the Kefevî's work where he presented his arguments about shari'a. It will depict and
discuss how Kefevî made a connection between the previous shari'as and the last one that Allah
(jalla jalaluhu) revealed to the Prophet Muhammed (pbuh) and how he established the scholarly
link between the Prophet Muhammed (pbuh) and the Imam Abu Hanife, the eponymous founder
of the Hanafi school of thought
