SUBJECT:

FY 2008-09 TUBERCULOSIS CONTROL REVENUES AND SERVICES (DistrictS: ALL)




OVERVIEW:




The County of San Diego provides for the prevention and control of tuberculosis through a combination of Federal, State and other funding methods. Pursuant to authority provided by this Board on March 16, 1999 (3) allowing Public Health Services to seek outside funding to prevent the spread of communicable diseases, the Health and Human Services Agency has obtained grant awards from the Centers for Disease Control and Prevention, Housing and Urban Development and State of California Department of Public Health, and other sources for countywide tuberculosis treatment and control services to reduce the incidence rate and transmission of tuberculosis in the County.
Today’s action requests Board approval to accept revenues awarded by the Centers for Disease Control and Prevention, Housing and Urban Development and the State of California Department of Public Health, for tuberculosis treatment and control services.




FISCAL IMPACT:




Funds for this proposal are included in the FY 2007-2009 Operational Plan for the Health and Human Services Agency. If approved, this proposal will result in additional costs and revenue of $20,000 in FY 2007-08 and subsequent year costs and revenue of $3,294,680. The funding sources are the Centers for Disease Control and Prevention, California Department of Public Health, and Housing and Urban Development through its fiscal intermediary, St. Vincent De Paul Villages. There will be no change in net General Fund Cost and no additional staff years.




RECOMMENDATION:




CHIEF ADMINISTRATIVE OFFICER

  1. Waive Board Policy B-29, Fees, Grants, Revenue Contracts – Department Responsibility for Cost Recovery.


  1. Accept revenue from the Centers for Disease Control and Prevention in the amount of $1,720,292 in the Health and Human Services Agency, Tuberculosis Control Program, for tuberculosis control and treatment services for Grant term January 1, 2009 through December 31, 2009.




  1. Accept revenue from the State of California Department of Public Health in the amount of $674,388 for Grant term July 1, 2008 through June 30, 2009 for tuberculosis control and treatment services, and $850,000 for Grant term October 1, 2008 through September 30, 2009, for the Refugee Health Assessment Program, in the Health and Human Services Agency, Tuberculosis Control Program.




  1. Accept revenue from the State of California Department of Public Health in the amount of $20,000 for Grant term of February 1, 2008 through September 30, 2008, in the Health and Human Services Agency, Tuberculosis Control Program, for the Refugee Health Assessment Program.




  1. Accept revenue from Housing and Urban Development through St. Vincent De Paul Villages in the amount of $50,000 in the Health and Human Services Agency, Tuberculosis Control Program, for Grant term July 1, 2008 through June 30, 2009, to house homeless non-infectious tuberculosis patients for tuberculosis medication and treatment.

NOTICED PUBLIC HEARING:

FINAL PROPOSED FY 2008-09 ANNUAL FUNDING PLAN FOR CDBG, HOME, ESG, AND HOPWA PROGRAMS; REALLOCATION OF PREVIOUS YEARS’ CDBG, HOME, AND ESG FUNDING; AND AUTHORIZATION OF THREE REQUESTS FOR PROPOSALS (DistrictS: ALL)




OVERVIEW:




This County of San Diego Consortium Consolidated Annual Funding Plan is the culmination of community meetings held throughout the county to solicit proposals for revitalization of qualified communities and development of affordable housing for lower-income residents. On March 11, 2008 (10), the Board of Supervisors conducted a public hearing on the Draft County Consortium Fiscal Year 2008-09 Annual Funding Plan for the Community Development Block Grant, HOME Investment Partnerships (including the American Dream Downpayment Initiative), Emergency Shelter Grant, and Housing Opportunities for Persons with AIDS Programs, and approved the Plan, in principle.
The Fiscal Year 2008-09 entitlement funding for each program is as follows: Community Development Block Grant ($4,637,376); HOME Investment Partnerships ($3,838,789) and HOME American Dream Downpayment Initiative ($29,446); Emergency Shelter Grant ($207,599); and Housing Opportunities for Persons with AIDS Programs ($2,646,000). The four federal programs will provide $11,359,210 in Annual Plan funds, a cumulative decrease of $258,767 from the four entitlement program funding levels in Fiscal Year 2007-08. Fiscal Year 2008-09 is the seventh consecutive year of decreases in CDBG Program funding, totaling 36.05% in reduced funding over the last seven years. In addition, an estimated $944,750 in Fiscal Year 2008-09 Program Income will be received, primarily from loan repayment proceeds, providing a total of $12,303,960 in Fiscal Year 2008-09 for community revitalization and affordable housing that benefits low-income residents and persons with special needs. A total of $1,753,196 in prior year’s funding, made available through cancelled and completed projects, will be reallocated to eligible recipients.
The proposed recommendations will accomplish five objectives: first, approve the County Consortium Fiscal Year 2008-09 Annual Funding Plan; second, reallocate up to $1,058,502 from previous years’ budgets for funding of eleven additional Community Development Block Grant projects; third, reallocate up to $661,417 from previous years’ budgets for two HOME Investment Partnerships projects; fourth, reallocate up to $33,277 for four Emergency Shelter Grant projects; and finally, authorize County Purchasing and Contracting to issue three Requests for Proposals.




FISCAL IMPACT:




Funds for this request in the amount of $12,303,960 are included in the CAO’s Proposed Operational Plan for Fiscal Year 2008-09. The funding sources are Community Development Block Grant ($4,637,376), HOME Investment Partnerships ($3,838,789 plus $29,446 in American Dream Downpayment Initiative), Emergency Shelter Grant ($207,599), and Housing Opportunities for Persons with AIDS ($2,646,000) programs, and estimated Program Income of $944,750 from the Community Development Block Grant Program ($446,000) and HOME Investment Partnerships Program ($498,750). If approved, this request will also result in the reallocation of $1,058,502 in prior year Community Development Block Grant funds, reallocation of $661,417 in prior year HOME Investment Partnerships funds, and up to $33,277 in prior year Emergency Shelter Grant funds. Appropriations of $210,000 will be established in the Capital Outlay Fund for Capital Project 1012118, Campo Community Center Parking Lot, based on the reallocation of Community Development Block Grant funds. This will require the addition of no staff years and there is no General Fund cost.




BUSINESS IMPACT STATEMENT:




If approved, these recommendations will have a positive impact on the business community. Most of the recommended projects include construction that will be implemented by private construction firms selected through a competitive bid process.




RECOMMENDATION:




CHIEF ADMINISTRATIVE OFFICER

  1. Approve for submittal to the U.S. Department of Housing and Urban Development the attached County Consortium Fiscal Year 2008-09 Annual Funding Plan for the Community Development Block Grant, HOME Investment Partnerships (including the American Dream Downpayment Initiative), Emergency Shelter Grant, and Housing Opportunities for Persons with AIDS Programs.

  2. Adopt the Resolution certifying compliance with the Housing and Community Development Act of 1974, as amended, and authorize transmittal of the Fiscal Year 2008-09 Annual Funding Plan to the U.S. Department of Housing and Urban Development.

  3. Authorize the Director, Department of Housing and Community Development, to execute Certification forms required by the U.S. Department of Housing and Urban Development for the Fiscal Year 2008-09 Community Development Block Grant, HOME Investment Partnerships (including the American Dream Downpayment Initiative), and Emergency Shelter Grant programs, and other relevant documents on behalf of the County Consortium.

  4. Approve and authorize the Director, Department of Housing and Community Development, to execute Fiscal Year 2008-09 Community Development Block Grant, HOME Investment Partnerships (including the American Dream Downpayment Initiative), and Emergency Shelter Grant agreements, between the County of San Diego and U.S. Department of Housing and Urban Development, upon receipt.

  5. Approve and authorize the reallocation of up to $1,058,502 in Community Development Block Grant funds to the following eleven projects: FY 2008-09 Fallbrook Boys and Girls Club Parking Lot ($250,000); FY 2008-09 Spring Valley Community Day Care Center ($230,000); FY 2008-09 Campo Community Center Parking Lot ($210,000); FY 2008-09 Regional-City/County Reinvestment Task Force (up to $70,000); FY 2008-09 Campo Community Center Stairs ($25,000); FY 2008-09 East Alvarado (Potter/Mercedes) Sidewalks Construction ($25,000); FY 2008-09 Lincoln Acres-Ridgeway Drive Sidewalks Construction ($10,000); FY 2008-09 Lincoln Acres Grove Street Sidewalks Design and Construction ($3,000); FY 2010-15 Regional Analysis of Impediments to Fair Housing Choice (up to $25,000); FY 2008-09 City of Poway Removal of Architectural Barriers ($5,108); FY 2008-09 City of Lemon Grove Street Rehabilitation Program Advance ($205,394), from the following Community Development Block Grant projects: cancelled FY 2007-08 East Elder Street Sidewalks Preliminary Engineering and Design ($35,000); cancelled FY 2007-08 Julian High School Ballfield Artificial Surfacing ($230,000); completed FY 2007-08 Campo Community Center Stormwater System Improvements ($25,000); completed FY 2007-08 Spring Valley Trash Cleanup ($440); completed FY 2007-08 Shelter Valley Volunteer Fire Department Rescue Truck ($46); cancelled FY 2006-07 Alpine Child Care Center Improvements ($8,000); cancelled FY 2006-07 Campo Freedom Ranch Building Addition ($36,000); completed FY 2006-07 Casa De Oro Estrella Park Development Design ($181); completed FY 2006-07 Guatay Community Water Well ($418); completed FY 2006-07 Homebuyer Education and Credit Counseling ($2,000); completed FY 2006-07 Mobilehome Mediation Services ($3,413); completed FY 2006-07 Urban County Fair Housing Program ($169); completed FY 2006-07 Regional Task Force on the Homeless ($89); cancelled FY 2005-06 Boulevard Fire Department Well Supplement ($16,000); completed FY 2005-06 Valley Center Park Pool Restroom ADA Improvements ($8,025); completed FY 2004-05 Boulevard Fire Department Well ($5,759), and the Housing Development Fund ($687,962).

  6. Establish appropriations of $210,000 in the Capital Outlay Fund for Capital Project 1012118, Campo Community Center Parking Lot, based on unanticipated revenue from Community Development Block Grant (CDBG) funds. (4 VOTES)

  7. Approve and authorize the reallocation of up to $20,000 in HOME Investment Partnerships Program funds from the previously cancelled Carlsbad Residential Rehabilitation Program to the Carlsbad Down Payment and Closing Costs Assistance Program, contingent upon final approval by the Carlsbad City Council.

  8. Approve and authorize the reallocation of up to $450,000 in HOME Investment Partnerships Program funds to the Encinitas Mobile Home Rehabilitation Program based on program revenue received from a loan repayment on the Encinitas Ranch Apartments project, contingent upon final approval by the Encinitas City Council.

  9. Approve and authorize the reallocation of up to $8,106 in HOME Investment Partnerships Program funds from the La Mesa Housing Rehabilitation Program and up to $57,030 in program revenue received from the La Mesa Rehabilitation Program, for a total allocation of $65,136 to the La Mesa Down Payment and Closing Costs Assistance Program, contingent upon final approval by the La Mesa City Council.

  10. Approve and authorize the reallocation of up to $26,281 in HOME Investment Partnerships Program funds from the Vista Tenant Based Rental Assistance Program and up to $10,000 in program revenue received from the Vista Homeownership Assistance Program, for a total allocation of $36,281 to the Vista Residential Rehabilitation Program, contingent upon final approval by the Vista City Council.

  11. Approve and authorize the reallocation of up to $90,000 in HOME Investment Partnerships Program funds from the FY 2007-08 HOME Administration fund to fund the FY 2010-15 San Diego Consortium Consolidated Plan.

  12. Approve and authorize the reallocation of up to $33,277 in Emergency Shelter Grant funds to the following four projects: Ecumenical Council of San Diego County (up to $7,505); North County Solutions for Change (up to $7,841); North County Interfaith Council (up to $8,901); and, North County Serenity House (up to $9,030), from uncommitted FY 2007-08 Emergency Shelter Grant funds ($33,277).



  1. In accordance with Section 401 of Article XXIII of the County Administrative Code, authorize the Director, Department of Purchasing and Contracting to issue a Request for Proposals to procure services related to continuation of the Mobile Home Mediation Services Program; and upon successful negotiations and determination of a fair and reasonable price, award a contract for a term of one year with up to two one-year option years and up to an additional six months if needed; and to amend the contract, as needed, to reflect changes to service and funding allocations, subject to the approval of the Director of the Department of Housing and Community Development.

  2. In accordance with Section 401 of Article XXIII of the County Administrative Code, authorize the Director, Department of Purchasing and Contracting to issue a Request for Proposals to procure services related to continuation of the Supportive Housing Program Consultant Services Program; and upon successful negotiations and determination of a fair and reasonable price, award a contract for a term of one year with up to two one-year option years and up to an additional six months if needed; and to amend the contract, as needed, to reflect changes to service and funding allocations, subject to the approval of the Director of the Department of Housing and Community Development.

  3. In accordance with Section 401 of Article XXII of the County Administrative Code, authorize the Director, Department of Purchasing and Contracting to issue a Request for Proposals to procure services related to development of the FY 2010-15 San Diego Consortium Consolidated Plan, and upon successful negotiations and determination of a fair and reasonable price, award a contract for a term of one year and up to an additional six months if needed; and to amend the contract, as needed, to reflect changes to service and funding allocations, subject to the approval of the Director of the Department of Housing and Community Development.

  4. Authorize the Director, Department of Housing and Community Development, to execute all necessary documents for the submittal, regulatory processing and/or implementation of the County Consortium Fiscal Year 2008-09 Annual Funding Plan for the Community Development Block Grant, HOME Investment Partnerships (including the American Dream Downpayment Initiative), Emergency Shelter Grant, and Housing Opportunities for Persons with AIDS programs, and recommended projects described in Recommendations #5 through #15.

  5. Authorize the publication of any required "Notices to the Public of Request for the Release of Funds" for previously approved projects, recommended projects in the Fiscal Year 2008-09 Annual Funding Plan, and projects described in Recommendations #5 through #15; authorize the Director, Department of Housing and Community Development, to execute Requests for Release of Funds; and direct staff to transmit these requests to the U.S. Department of Housing and Urban Development upon completion of any mandatory waiting period.

  6. Authorize the Director, Department of Housing and Community Development, in consultation with County Counsel, to negotiate and award contracts, or contract amendments, to recipients of the recommended projects in the Fiscal Year 2008-09 Annual Funding Plan and in Recommendations #5 through #15, following the completion of environmental processing and U.S. Department of Housing and Urban Development release of funds, if applicable.




ACTION:




ON MOTION of Supervisor Jacob, seconded by Supervisor Slater-Price, the Board closed the Hearing and took action as recommended, on Consent, adopting Resolution No. 08-076, entitled: A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN DIEGO APPROVING THE 2008-09 ANNUAL FUNDING PLAN.

SUBJECT:

COMMUNITY DEVELOPMENT BLOCK GRANT, HOME INVESTMENT PARTNERSHIPS, AND EMERGENCY SHELTER GRANT COOPERATION AGREEMENTS FISCAL YEARS 2009-10, 2010-11, AND 2011-12 (DistrictS: ALL)




OVERVIEW:




These requested actions will result in the execution of Urban County Cooperation Agreements between the County and participating cities. These agreements will allow small cities within the County to participate in the federal Community Development Block Grant, HOME Investment Partnerships, and Emergency Shelter Grant Programs during Fiscal Years 2009-10, 2010-11, and 2011-12. These requested actions will also result in the execution of a County HOME Consortium Cooperative Agreement between the County and HOME Consortium cities for participation in the HOME Investment Partnerships Program. These federal programs provide funds for the revitalization of lower-income communities and development of affordable housing for low-income residents and persons with special needs.




FISCAL IMPACT:




The funding sources are the Community Development Block Grant, HOME Investment Partnerships, and Emergency Shelter Grant Programs. The Fiscal Year 2008-09 allocation for the Community Development Block Grant Program is $4,637,376, which is 3.75% less than received in FY 2007-08, for a decrease of $180,846. The Fiscal Year 2008-09 allocation for the HOME Investment Partnerships Program is $3,838,789, which is 3.23% less than received in FY 2007-08, for a decrease of $128,003. The Fiscal Year 2008-09 allocation for the Emergency Shelter Grant is $207,599, which is 0.71% less than received in FY 2007-08, for a decrease of $1,486. The actual amounts of the Fiscal Year 2009-10 allocations will not be known until the federal Fiscal Year 2009 budget is adopted. If approved, these actions will result in no current year costs, annual costs, or additional staff costs.




RECOMMENDATION:




CHIEF ADMINISTRATIVE OFFICER

  1. Adopt a Resolution authorizing the Director, Department of Housing and Community Development, to execute the Urban County Cooperation Agreements for the Community Development Block Grant, HOME Investment Partnerships, and Emergency Shelter Grant Programs between the County of San Diego and the eligible Urban County participating cities, contingent upon and following approval by all city councils, and authorize the Clerk of the Board to attest to the resolution.

  2. Authorize the Director, Department of Housing and Community Development, to execute the HOME Investment Partnerships Cooperative Agreement between the County of San Diego and the eligible HOME Consortium cities, contingent upon and following approval by all participating city councils.

  3. Authorize the Director, Department of Housing and Community Development, to confirm all the premises set forth in the U.S. Department of Housing and Urban Development Certification forms, and to sign these certification forms as required.

  4. Designate the Director, Department of Housing and Community Development, to assume, on behalf of the Board of Supervisors, the status as the responsible federal official under the National Environmental Policy Act.

  5. Authorize the Director, Department of Housing and Community Development, to negotiate and execute, with County Counsel concurrence, all contracts, agreements and/or amendments, and to take all necessary actions for the submittal and/or regulatory processing of the above-referenced Agreements and Resolutions.
