3 The term “clergy” includes bishops, priests and deacons. References to priests and deacons in this policy shall also refer to bishops unless the contrary is clear from the context or is specifically stated. While bishops are held to the same exacting moral standards as other members of the clergy, the process for investigating a complaint against a bishop and any subsequent discipline is carried out under the direction of the Apostolic See.


4 This policy refers to sexual abuse by clergy, whether incardinated in the Archdiocese or serving here while incardinated in another diocese or community. The Archdiocese has issued similar policies governing sexual abuse by lay persons serving in ministerial capacities.


5 In addition to reports mandated by the law of the State of California, the Archdiocese has committed itself to a policy of reporting in cases beyond the mandate. The provisions of that policy can be found in Appendix 4 of the Archdiocesan Clergy Policies and Guidelines.


6 A minor is any person below the age of eighteen (18). See the Holy See’s derogation of the provision of canon 1395, §2, dated November 30, 1993, as well as the Norms governing the graviora delicta of April 30, 2001.

8 When adults are involved, sexual abuse occurs when a bishop, priest or deacon takes sexual advantage of another person, when he intentionally engages in sexual contact or touching in the context of providing pastoral care, or when he is guilty of sexual harassment, such as unwanted sexual advances or suggestions. This policy does not address sexual misconduct on the part of a cleric that violates his commitment to celibacy or of a deacon that violates his commitment to chastity in matrimony, even if there is scandal, if none of the above-described conditions is present. Nonetheless, even when not meeting the criteria of abusive conduct, the Archbishop has the canonical responsibility to issue norms and pass judgment in cases of violation of these moral and canonical obligations of celibacy and chastity (canon 277, §3).


9 This fulfills the commitment of Article 2 of the Charter which states: “Dioceses/eparchies will have mechanisms in place to respond promptly to any allegation where there is reason to believe that sexual abuse of a minor has occurred.” (emphasis added)
