Lack of rules and guidelines can result in inconsistent quality and accessibility when it comes to digitizing and preserving cultural assets. Developing standards and guidelines can help to ensure the consistency and quality of digital materials.

Copyright

Many cultural heritage collections are subject to copyright restrictions. Digitization can raise legal and ethical issues, such as how to balance access to cultural heritage with the rights of copyright holders.

Cybersecurity

Digital cultural heritage is vulnerable to cyber attacks, which can compromise the authenticity and integrity of digital materials. Developing cybersecurity protocols and ensuring the security of digital infrastructure is crucial for protecting digital cultural heritage.



CONCLUSION


The protection, marketing, and accessibility of cultural objects are distinct difficulties and opportunities brought about by the digitization of cultural heritage. We have examined a number of legal, intellectual property, and practical issues of digital cultural heritage in this essay.
In Chapter 1, we examined the definition and categories of cultural heritage, as well as the international legal framework for its protection. We also discussed the relevance of intellectual property protection mechanisms for cultural heritage and how they can be applied to digital cultural heritage.
In Chapter 2, we focused on understanding digital cultural heritage, including its causes, effects, and the tension between access and control over digital cultural heritage. We looked at how intellectual property fits into this conflict and what exceptions and restrictions can be made for digital cultural assets when using intellectual property rights.
In Chapter 3, we delved into practical issues in the digitization of cultural heritage, drawing on international and Azerbaijani experiences. We looked at the present state and future potential for digital cultural heritage in Azerbaijan as well as the function of national policy in preserving it.
Overall, our analysis has shown how crucial it is to use a variety of legal and practical tools to safeguard and promote cultural heritage, both tangible and intangible. Additionally, it has highlighted the necessity of striking a balance between access and control over digital cultural material while simultaneously making sure that intellectual property protection measures do not obstruct its preservation and accessibility.
Moving forward, we suggest several recommendations for addressing the challenges and opportunities of digital cultural heritage.
First, our most basic proposal is to create a single mechanism to ensure the dissemination of cultural heritage on electronic platforms (websites, e-carriers and e-government portals) after digitization. This mechanism should reflect legal (in terms of intellectual property rights) and technical (in terms of electronicization and legislative techniques) indicators.
Second, while also protecting the rights and interests of cultural heritage institutions, creators, and the general public, access to digital cultural heritage should be made freely available.
Third, stakeholders must work collaboratively to develop and implement best practices for digitizing and preserving cultural heritage.
Fourth, in order to guarantee that cultural heritage is safeguarded and promoted on a worldwide scale, international collaboration and the exchange of information and experience must be encouraged.
In conclusion, it should be noted that digitizing cultural material is a complicated and multifaceted subject that calls for careful thought and cooperation among various parties. We can make sure that cultural heritage is maintained, promoted, and available for future generations to enjoy and appreciate by addressing the legal, intellectual property, and practical difficulties and opportunities of digital cultural heritage.
