REPORT ON THE 1ST MEETING

OF THE PROJECT


“Action Programme to improve transboundary cooperation and sustainable management of the Dniester river” (DNIESTER II)



Kiev, Ukraine, 10-11 August 2006

A. ORGANISATION OF THE MEETING


  1. The 1st Meeting of the the project “Action Programme to improve transboundary cooperation and sustainable management of the Dniester river” (Dniester II) was held in Kiev, Ukraine 10-11th August 2006. The meeting was organized by the Organisation of Security and Cooperation in Europe (OSCE) and the United Nations Economic Commission for Europe (UNECE).

  2. The Dniester II project is implemented by OSCE and UNECE in collaboration with authorities and NGOs from Ukraine and Moldova. The project aims at the improvement of the joint management of the river basin. The project is part of the ENVSEC initiative. The principal outputs of the project are: 1) an agreed Action Programme (AP) to improve the transboundary water management of the Dniester River Basin, and 2) a river basin website managed by Ukrainian and Moldovan authorities.


Objectives of the Meeting


  1. The main objectives of the meeting were 1) to introduce the project to its participants from Moldova and Ukraine and to agree on different issues related to its implementation , 2) to discuss one of four topics of the future AP: “The legal framework for cooperation”.


Attendance


  1. The meeting was attended by 16 experts from Moldova, Ukraine, staff members of UNECE, OSCE Project Coordinator in Ukraine (OSCE PCU), UNEP/GRID – Arendal, and a consultant on the international water legislation. The list of participants is provided in Annex 1.


Opening of the Meeting


  1. The participants were welcomed by Mr Libert, Regional Advisor on Environment, the UNECE secretariat. Afterwards a round-table presentation of the participants of the meeting was made.

  2. The meeting agenda was approved (see Annex 2).


B. PROCEEDINGS
Information



  1. Mr Trombitsky informed the participants about a workshop organised together with the German colleagues in May 2006. One of the issues discussed at the meeting was public participation and best institutional practices of transboundary rivers management in the management of the European rivers.

  2. Mr Trombitsky also informed about the designation of 11 June as the Dniester Day.

Ukrainian colleagues were encouraged to join this initiative. A major conference

commemorating the 100 years since the birth of the Academician Lev Berg’s was organised

in Bendery (Transdniester, Moldova) in March 2005. The conference served as a good

platform for discussions between Ukrainian and Moldovan colleagues. The Proceedings of

the conference will be published soon.


  1. Mrs Guvir informed about a new Moldovan-Ukrainian project “Transboundary Risk Management in the Dniester Basin” coordinated by the Federal Bureau on the Environment of Germany (UBA). The aim of the project is development of the intergovernmental cooperation on accidents prevention in the Dniester basin. A training of inspectors dealing with risk assessment and management will be held together with Ukrainian colleagues in Chisinau in November 2006. A transboundary centre on reaction to transboundary accidents is to be established as well.

  2. The final report and publication from the project “Transboundary Diagnostic Study for the Dniester River Basin” was presented. The distribution of the available copies and additional printing was discussed.



Project implementation

Mr Libert presented the “Dniester II” project and the following points were discussed:



  1. It was stressed that the Helsinki Convention and principles of the Water Framework Directive are important corner stones for the work of the Dniester II project.

  2. It was suggested to develop collaboration with the Global Water Partnership for the future work on Dniester. The need to inform/cooperate with other departments and experts within organisations represented by the participants was also highlighted. Aarhus Centres were mentioned as one option for dissemination of information.

  3. Ms Elena Veligosh informed that ENVSEC has received a project proposal on cooperation between Ukrainian and Moldovan Ministry of Health. It was agreed that efforts will be made to link the new proposed project to the efforts on health issues that is included in this project.

  4. The timing and possible venues of future project meetings were discussed. It was seen as an option to organise not 4 but 5 project meetings if the funds allowed.

  5. An e-bulletin will be produced to disseminate information about the project. Also travel of representatives from Moldova and Ukraine will be funded to present the project during the Meeting of the Parties of the Water Convention in Bonn in November 2006.

  6. The possibilities to involve the Transdniester authorities in the project were discussed. Participants agreed that efforts should be made to make that possible.

  7. Ms Veligosh made a presentation on experiences from information work made by GRID-Arendal. The information component of the project was discussed briefly, and the establishment of a transboundary GIS for the river basin was highlighted as a priority.



The legal framework for cooperation


  1. Mr Vinogradov made a presentation covering:

a) the international framework for transboundary cooperation on water management and environmental protection,

b) an analysis of the Dniester Agreement of 1994 (mainly focusing on weaknesses), and

c) alternatives for the improvement of the legal framework for cooperation.

Three alternatives for future action were presented by Mr Vinogradov:



  1. Full revision of the Agreement of 1994

  2. Adoption of a separate Agreement on the Dniester basin

  3. 3.1. “Modernisation” of the existing legal framework from 1994 (short-term perspective) and 3.2. Development of a new Agreement for the Dniester basin (long-term perspective). These two directions should be developed in parallel.

  1. Project participants agreed that the development of a new Agreement (variant 3.2) in parallel with the “modernisation” of the existing mechanism for cooperation (variant 3.1) is the preferred approach.

It was suggested that one approach to improve the 1994 Agreement is to develop

regulations on certain issues. 2 regulations are to be approved at a meeting of

Plenipotentiary in October 2006. Another issue that was raised was that additional working

groups, for example on biodiversity should be instituted.



  1. On the second day Mr Vinogradov presented a concept for a new Agreement on the Dniester river basin including:

  1. Title

  2. Aims and Objectives

  3. Application (geographically and types of human activities)

  4. Definitions

  5. Rights and Responsibilities

  6. Procedure (information exchange, coordination of planned activities, emergencies, assistance)

  7. Institutional Mechanism (plenipotentiaries, a commission, competence, structure, public participation, basin action plans)

  8. Responsibilities and Compensation of the Transboundary Damage

  9. Compliance

  10. Mechanisms for Conflict Resolution and Disputes (traditional or a basin body or involvement of the third party).


C. CONCLUSIONS AND DECISIONS
The following decisions were made by the participants:

Regarding the current meeting:

  1. Draft minutes, list of participants, presentations and a full Russian version of the project document with budget will be disseminated in one week after the meeting (by Ms Kutonova). Participants would have one week to comment on the minutes. After that the approved minutes would be disseminated.

  2. All participants were asked to send e-mail addresses to which small e-information bulletin prepared after each meeting will be distributed. Ms Kutonova will establish such a list.

  3. Each delegation will nominate 3 persons for the information group from each country. These experts will meet for the first time in Odessa in September. Information about the nominees should be sent to Ms Kutonova during the week following the Kiev meeting.

  4. Mrs Shumeyko will send the existing Ukrainian-Moldovan regulations to Ms Kutonova within a week after the meeting.


Regarding the 2nd meeting

  1. The next meeting will take place in Odessa 22-23 September. Three parallel meetings are planned: the information management group, epidemiological services and the national delegations

  2. A draft concept for a new Agreement on Dniester will be prepared by Mr Vinogradov and sent to Ms Kutonova for further dissemination to the national delegations before the meeting in Odessa.

  3. To cooperate with The State Committee of Water Management and Mama 86 in Odessa in the preparation of the September meeting.

  4. To inform epidemiological stations on the meeting and develop a short concept paper on the links between the Sanepidem meeting and this project (Mr Trombitskiy and Mr Ivan Ignatyev).

  5. To invite REC and legal experts from each country to the meeting (a Moldovan legal expert needs to be nominated).


Other issues

  1. The third meeting of the project will take place on 30-31 October in Moldova.

  2. More copies of the project of the previous project should be printed. It was agreed that it would be valuable if the Ukrainian-Moldovan Protocol on Cooperation on the Dniester (2005), the Agreement (1994), and the legal analysis of the Agreement made by Mr Vinogradov (2005) could be added in the reprint.

  3. 100 copies of the present publication should be sent to OSCE Kiev, 150 – to Eco-Tiras for further distribution in the respective countries.

  4. Ms Veligosh agreed to facilitate the exchange of information between the on-going TACIS project and this project in an up-coming meeting.

  5. Ms Veligosh also agreed to distribute information of EU funding opportunities to the project participants.

  6. Mr Melian agreed to develop a concept paper for the links between the German Early Warning and Emergency Situations Project and the Dniester II project.

  7. Mr Melian also agreed to draft a concept paper for the work of the information group of the Dniester II project.

  8. Mr Babich, the State Committee for Water Management in Ukraine will take necessary steps to register the Dniester project with the Ministry of Economy.

  9. Mr Ignatyev agreed to present the project to relevant Transdniester authorities and to communicate the result of the meetings to Ms Kutonova.
