REGULAR COUNCIL MEETING

TUESDAY, AUGUST 20, 2013

7:00 P.M.

Mayor Williams called the regular monthly Council meeting to order at 7:00 p.m. with council members Batchelor, Bobrofsky, Englebretson, Froeba, Geier, Gluch-Voss(came late 7:18p.m.), McBride, and Schmitt present.

The Pledge of Allegiance was recited.

Citizens present were Judy Bobrofsky, Carl Becker, Tom Odeen, Paul Gries, Katie Weiler, Dean Lesar, Cale Jackson, and Deb Roedel.

Clerk Toufar verified the postings.

No corrections or additions were made to the August 20, 2013, council agenda.

Deb Roedel talked about the Community Relations Committee that they have at school and shared information about the school and would like the school and the city to work together if any issues that come about that either of them would need help with. Roedel stated some of them would be equipment sharing, community service, and would like council members to attend awards ceremonies.

Motion was made by McBride to approve the minutes from July 16, 2013, regular Council meeting, seconded by Englebretson. Motion carried.

Treasurer’s report was approved on a motion made by Englebretson, seconded by Geier. Motion carried.

Utility Committee-Meeting was held on August 15, 2013. Froeba talked about the letter that was received from the Department of Transportation about the Main St. project. Schmitt made a motion to give Mayor Williams permission to sign the letter, seconded by Bobrofsky. Motion carried. Koski opened up the bid that came in for the demolition of the building at 333 N Main St. Marawood Construction came in at a bid of $38,500. This has been tabled to the next utility committee and Koski will get in contact with attorney William Gamoke. Next meeting will be held on September 3, 2013.

Police/Fire and Ambulance-Police meeting was held on August 7, 2013. Gluch-Voss read the ordinance 7-1-6 (c) amending dogs and cars running at large.

Gluch-Voss made a motion to amending the following ordinance

AN ORDINANCE PROVIDING FOR THE AMENDING OF SUBSECTION 7-1-6(C) OF THE CODE OF ORDINANCES FOR THE CITY OF LOYAL PERTAINING TO RESTRICTIONS ON KEEPING DOGS AND CATS AND DOMESTICATED ANIMALS.

The Common Council of the City of Loyal does hereby ordain as follows:

Section 1: The provisions of Sections 7-1-6(c) of the Municipal Code of the City of Loyal are hereby amended as set for the in Section 2 of this Ordinance.

Section 2:



Section 7-1-6: RESTRICTIONS ON KEEPING OF DOGS, CATS, AND DOMESTICATED ANIMALS.

(C) DOGS, CATS, AND DOMESTICATED ANIMALS RUNNING AT LARGE.

(1) It shall be unlawful for any person owning or possessing any dog, cat, or domesticated animal to permit the same to run at large. For the purpose of this subsection, “running at large” shall be defined to be in the presence of a dog, cat, or domesticated animal at any place except upon the premises of the owner.

(2) A dog, cat, or domesticated animal shall not be considered to be running at large if it is on a leash and under control of a person physically able to control it.

Section 3: All other provisions of Section 7-1-6 are reaffirmed without any change or amendment thereto.

Section 4: SEVERABILITY AND CONFLICTS OF LAW. If any provision of this Ordinance is found to be unconstitutional or otherwise contrary to law, then such provision shall be deemed void and severed from the Ordinance and the remainder of this Ordinance shall continue in full force and effect.

Section 5: EFFECTIVE DATE. This Ordinance shall take effect and be enforced from and after the date of its passage and publication, as provided by law.

Seconded by Batchelor, motion carried. Gluch-Voss reported that a letter has been written and sent about fireworks in the City of Loyal. Gluch-Voss reported that they met the 2 new part-time officers, Jeremy Ruggles, and Kyle Pokallus.

Fire and Ambulance meetings were held on July 25, 2013. Gluch-Voss reported on both meetings. 2013 officers were voted on. Gluch-Voss reported that a control burn was done at the Plaskey residence.

Finance Committee –No meeting held. Next meeting will be held on September 4, 2013.

Library Committee – No meeting held.

Personnel Committee – No meeting held.

Park & Recreation – No meeting held.

City View Estates-Meeting was held on July 30, 2013. Williams reported that the covenants were approved with some minor changes. Schmitt made a motion to approve the N 38ft of Lot 13 of the City View Estates to Matt Kubista, seconded by Englebretson. Motion carried. McBride made a motion to sell Lots15, 16, and ½ 17 to Cale Jackson in the amount of $8,125.00, seconded by Geier. Motion carried.

Economic Development – Williams reported that Lot 20 in the Industrial Park has been sold to Northside Elevator.

Clerk’s Report-Clerk Toufar reported that the wood carving of the ear of corn was donated to the City from REN Manufacturing (Roger & Elizabeth Nikolai). Clerk Toufar asked all council members to please sign the thank you card. Clerk Toufar also reported that on August 27, 2013 at 4p.m. the school will be having a meet and greet for new teachers and staff and they would like to invite the City Council to join.

Mayor’s Report-Mayor Williams reported on the mayor’s meeting. The Highground is looking for donations. The finance committee will put into the 2014 budget. Mayor Williams reported on the new businesses that have opened up.

Gluch-Voss made a motion to approve a picnic license for St. Anthony’s, seconded by Bobrofsky. Motion carried.

Bobrofsky made a motion to approve a cigarette license for Loyal Food & Gas LLC, seconded by Schmitt. Motion carried.

Schmitt made the motion to approve vouchers in the following amounts:

GENERAL FUND: $150,284.31 WATER UTILITY: $10,427.25

WASTEWATER UTILITY: $21,099.53

Seconded by Gluch-Voss. Motion carried.

Schmitt made the motion to adjourn, seconded by Englebretson. Motion carried.
