was created in order to perform the commitments. The SCP provided the reservation
representatives with training during 3 days. The reservation got technical equipments:
computer, printer. Currently the digital base of the reservation is developing. The web-
site of the reservation has been established. International Conference is planning to be
held in September-October.
Analysis:
The audit group evaluates issue related to Gobustan reservation as positive.
Recommendation:
Reservation employees should enlarge this good experience
3.2.4. Commitment:
According to SCP Commitments 208 (158) and 210 (162) on Cultural Heritage
Protection operative archeological control will be ensured during pipeline construction.
Observation:
According to the IAE representatives the biggest problem was transport problem during
a site researches. They were not provided with transport regularly. So as a result of it
some problems occurred during researches and during control over construction. This
problem also was outlined by the representatives of “Oxford Archaeology ” in audit
report, but no measures were taken.
Analysis:
The archeologist-experts faced some problems due to lack of transportation means.
Non-conformance:
SCP commitments # 208 (158) and 210 (160) on Cultural heritage protection plan were
not implemented adequately.
Recommendation:
The better archeological control over in future activities must be ensured.
3.2.5. Commitment:
According to the SCP commitments 213 (163) on the Cultural Heritage Protection :” To
discuss specific proposal for investigation work with the IoA in the event that there are
areas of archaeological interest outside the 44m corridor, but within the pipeline
restriction zone”.
Observation:
Researches were conducted as the result of the advice of representatives of the IoA in
the area of Tovuzchay (KP 377-378) in the 60 meters from 44m corridor. At the
beginning a number of workers was 12, later 57 more people were added.
Analysis:
The company fully implemented its commitment. The audit group evaluates this issue
as positive.

3.3. The Audit of contractor (CCIC) and National Partners (the ANAS IAE and
the Ministry of Culture) performance in meeting SCP requirements
and commitments
CCIC. There is procedure of cultural heritage protection of the company in accordance
with taken commitments. Contractor had procedures for Cultural Heritage Protection
that corresponded to the commitments. CCIC approached the responsibilities very
seriously and did its work in appropriate way- corresponded to all requirements of the
upper organization and international standards. The employees of the Contractor
company begin to work only after having the necessary trainings. They prepared weekly
report on archeological findings. They didn’t have registration for daily findings. When
they founded archeological findings they immediately stopped their work and inform
responsible persons about it.
The Institute of Archaeology and Ethnography. The
IAE is a leading organization of
the country in this sphere. According to the legislation of the Azerbaijan Republic
conduction of archeological researches, estimation of archeological findings is done
only by the IAE. But this activity can be conducted only with the agreements of The
Ministry of Culture of the AR according to “Historical and Cultural Monuments
Protection” law of the Azerbaijan Republic adopted in 10.04.1998, №470-IQ.
Having taken into consideration an important role of the Institute in this sphere, 2
meetings were held with them. The Institute employees involved in this work were very
professional and hard-working. They estimated the archeologist of BP very highly and
praised his activity. During the meeting it turned out that several findings of worldwide,
regional, and national importance, as well as a number of findings of occasional local
significance had been found.
3.3.1. Commitment:
According to the ESIA, ”Decisions concerning the significance of the archeological
monuments and relevant actions will be accepted jointly with The Ministry of Culture of
the AR and The Institute of Ethnography “.
According to “Historical and Cultural Monuments Protection” law of the Azerbaijan
Republic adopted in 10.04.1998, №470-IQ;
«The permission from appropriate executive organs and opinion of the NSAA for soil or
construction works in the area of historical and cultural monuments and instructions
given by them should be followed». CHMP 1.6 paragaph18.
Observation:
No letters of Department of Monument Protection and museums of Ministry of Culture
were replied by the company from the beginning of the site works of the BTC in 2000
until 2005. During the interview the representatives of the Company said that this
permission belong to The Institute of Archaeology and Ethnography. The IoAE notified
that there was no need for that.
Analysis:
• The SCP and its Contractors have no permission for archeological finds from
The Ministry of Culture of the AR. They do not have any written documents;
• According to Ministry of Culture, the representatives of IoAE work without having
contact with them. Therefore, they evaluate their activity as out of procedure;
• No information on findings was presented to Ministry of Culture
