  Reports on the SCP’s sensitive construction area 

After acquaintance with these documents the audit group made sure that they needed 

additional documents to review and asked to get the following documents: 

  Environmental and Social Management System manual (ESMS) №010/C  

  Audit reports of “Oxford Archaeology ” for Cultural Heritage management of the 

BTC in 08.10.2004; 

  Final report of NGO’s on audit of the BTC in 2005; 

  The relevant parts of the contract signed between the BTC and the IAE (№c-03-

BTC-55942); 

  Related to different KPs (Ashagi- Ayibli: 361; 358-357.5, Tovuzchay: 378, Poylu: 

409.2, 409.1, 408, 406) Written plan of Archeological excavation researches; 

  “Ethnography,  Folklore,  Archaeology    of  Caucasus"  conference materials  about 

the Cultural Heritage Management sponsored by the BTC in 14-17.12.2005; 

  Cultural  Heritage  Management  Plan for  Phase  5 (report  of  activity  Article  5, 

C.03.BTC-55942 Contract); 

  Last  archeological  findings  procedure  and  protocol  documents  (03.06.03, 

АGТ001); 

  Report  of  the  Institute  of  Archaeology  and  Ethnography  in  19.07.2002,  52-22-

125; 

  KP  378  re-route  alignment  for  minimizing  the  impact  on  Cultural  Heritage  in

2.6. Review of Documents and Preparation of Checklists  

After getting acquainted with the documents the following checklists were developed: 

  Checklist for Audit of the SCP in meeting commitments to the Cultural Heritage 

protection sphere; 

  Checklist for Audit of the SCP’s contractor -CCIC in meeting commitments to the 

Cultural Heritage protection sphere; 

  Checklist for Audit of commitments of the SCP’s National Partners – the IAE to 

the Cultural Heritage protection sphere; 

  Checklist for Audit of commitments of the SCP’s National Partners- The Ministry 

of Culture of the Azerbaijan to the Cultural Heritage protection sphere; 

  Audit  of  protection,  presentation,  cataloging  and  presenting  to  the  public  of  the 

report of archeological findings

III. Observations, Findings and Analysis 

 

Archeological researches strategy on project was based on two principles: modern and 

advanced  assessment  and  reduce  influence  of  pipeline  construction.  This  strategy 

includes five phases: 

Phase  1.  Baseline  Surveys  including  desktop  studies,  walk  through  surveys  and 

examination  of  aerial  photographs  leading  to  the  development  of  a  Cultural  Heritage 

Management Plan. 

Phase 2. Intrusive work-trial pits and preliminary investigation.  

Phase 3. Full investigation of threatened sites.  

Phase  4.  Activities  during  construction,  watching  brief  and  excavation  of  newly 

discovered sites. 

Phase  5.  Post  construction  work,  analysis  of  findings,  archiving  and  reporting, 

dissemination of the results of the work by various means. 

Evaluation  of  appropriateness  of  the  documents  submitted  for  audit  to  the  taken 

commitments proved that the submitted documents are appropriate to:    

▪National legislation, including “Historical and Cultural Monuments Protection” law of the 

Azerbaijan Republic adopted on 10.04.1998, №470-IQ; 

▪ Modern Cultural Heritage Protection standards  

Along  with  this  according  to  audit  report  developed  by  “Oxford  Archaeology  ”  on 

08.10.2004 the documents are appropriate to: 

  Requirements of International Legislation;  

  The principles of Creditors, International Financial Corporations; 

  International Standards and Commitments of the Organization;  

 

3.1. Audit Performance of SCP Requirements of 

 Cultural Heritage Management Plan 

As  a  part  of  the  ESIA  Cultural  Heritage  Management  Plan  aims  to  minimize  negative 

impacts of SCP to the cultural heritage and to strengthen positive impacts, including:   

  Protection  of  cultural  heritage,  and  communities  close  to  the  construction  area 

during the pipeline construction; 

  If it is possible moving pipeline in pre-construction period; 

  It  is  purposeful  to  implement  archeological  works  during  the  pipeline 

construction.   

It is intended to pay special attention to the following points in this plan: 

  Training of executor’s employee;  

  Protection of construction fields with special barriers;    

  Ensuring safe roads; 

  Respectful attitude toward cultural heritage in the regions close to pipeline; 

  Preparing  mechanism  of  elaborating  works  in  the  potential  archeological  fields 

during the construction period;

  Agreement mechanism of small movements of the pipeline in the places where it 

is possible;   

  Agreement mechanism on leaving the field.  

After  reviewing  documents  group  members  reviewed  documents  in  the  Gobustan 

Reservation, Shamkir, and Goranboy museums. 

    

3.1.1. Commitment: 

According to the Environmental and social management system manual (ESMS) (The 

contractor’s training (Point 6.3.2.2.)):  

“The construction Contractor provided considered 2 days training course for the staff”. 

Observation: 

There  is  no  commitment  of  Contractor  in  Cultural  Heritage  Management  Plan,  but  in 

Ecological  and  Social  Management  System  (ESMS)  it  is  emphasized  that  contractor 

must  develop  training  course.  The  Contractor  developed  50  pages  training  material. 

Only 2 of the pages were about archaeology  and they did not encircle this area totally. 

Analysis: 

The  insufficiency  of  information  delivered  to  the  staff  lead  to  less  efficiency  of 

employees  in  finding  archeological  monuments.    The  damage  to  the  grave  in  Girag 

Kesemenli  community  of  Agstafa  region  can  be  example.  This  fact  brought  about 

contradictory consideration in the mass media about BTC/SCP.  

 Recommendation: 

Contractor  has  to  take  into  consideration  this  matter  in  its  future  activities  and  should 

expand information about archeological findings. 

 

3.1.2. Commitment:  

“According  to  environmental  and  social  management  system  manual  (ESMS)  the 

Contractor has to develop self provision. The activities that took part during construction 

period of the project are monitoring Plans of Contractor. The plans were developed by 

the  BTC  Co    Company  to  understand  and  deliver  of  all  commitments  in  ground 

documents.    (Efficient  monitoring  of  Contractors`  activities.  document  №010/c)  (Point 

6.3.6.1.) 

Observation: 

Self-provision documents were not presented to contractor. 

Analysis: 

Contractor  Control  Plan  reflected  in  Ecological  and  Social  Management  System 

(ESMS) manual was missed.  

Recommendation: 

It  is  advisable  to  take  into  consideration  this  issue  in  the  future  activities  and  prepare 

Contractor Control Plan. 

 

3.1.3. Commitment: 

According to ESIA manual, the audit program consists of 3 activities:
