Hukuk Öğretiminde Yeni Yaklaşımlar: Hukuk Klinikleri

Alpaslan Azapağası: Sayın O’Brien’a bu güzel konuşmasından dolayı çok teşekkür ediyoruz, şimdi 2. konuşmacımız “Arap üniversitelerinde Hukuk Kliniği Öğretimi: Müfredatta Reform İhtiyacı” başlığı altında anlatacak, Sayın Mohamed Mattar’a vermek istiyorum, buyurun Sayın Mattar.

Mohamed Mattar: I promise I am not going to ask anybody to stand up. I am delighted to be here this time in this lovely university. So from the podium to the Dean, greetings and congratulations. But it is not the first time for me in Turkey. I am always here. In fact, I discovered that I spend more time in Turkey than I do in the United States. At least this is what my wife has been telling me. Next week on the 19th and 20th, I am organizing a conference in Istanbul on corporate social responsibility. The course that I taught in United States, also taught in Beirut Arab University and Kahire University. And I am including a session there, on business critics. A concept that I would like to promote in the Arab world. Sometimes it is difficult to promote anything in the Arab world but I am trying. And I did the scene was the concept of law clinic. Thanks to David. The history of clinic education in the Arab world is very young. We are talking about 8 or so years. The first law clinic was established in Morocco in 2005. Now we have law clinics all over the Arab universities including the University of Jordan. I am sure professor Diana will tell something about the good work that she has been doing at the clinic in Jordan. And, What I would like to do for 20 minutes or so, unless the chair would be kind to me to give 5 more minutes, we’ll find out. I would like to share with you 2 models of clinic education that I was performing. And I am proud. The first is what I call “The legislation project” Model. Last year, we have a spin for the annual conference on clinic education. And I heard a lecture for Professor Elizabeth cooper from United States for the law school. And she talked about influencing legislation and getting students to be involved, having impact on legislation in the country. So I decided to follow the model in some of our law clinics in the Arab World. And this last semester, I had the project on “drafting”, a law of rights of domestic workers. The most recent international convention is the ILO convention, international labor organization convention on recent work on domestic workers. And I discovered that the Dean teaches labor law, such a treat because I also teach labor law. So we got students to work on drafting modern law on the rights of the domestic workers, which is really the problem, the main problem in the Arab world, especially in the gulf area. I like the model because of many reasons. We don’t have student practice. So our students cannot go and appear before the court. Perhaps here the project model will work better than the service model. In addition, some of our professors are not allowed to practice law either. In Iraq, and I have helped established, clinics in Iraq. Now we have 5. Professors in Iraq are not allowed to practice law. You either become a professor and teaches a liberal or you become a lawyer and practice law. Also I like the model because by following. Service project model. You can bring more than 1 clinic to work together. So this is what I did. I had 3 trips and David Mason and I like to travel. In fact I travel every week. From there to Berlin and to Algeria and coming back for the corporate social responsibility conference. So I went to Sultan Kabus, university of all men, and then to Qatar University in Qatar. And then to the international Kuwait Law school in Kuwait. And three of them agreed for the first time to establish a clinic. For the first time. They had no clinics. And kind enough the dean of Qatar University made it 3 credit hours. I said I love you. So I went to Kuwait and they said they will only make it 2. I said I still love you. And then went to Albania and they said we are not going to have it as a credit hour we will have it as a program. And this is the two models we have in the Arab world. Or we have a program with no credit hours. But we have 2 models. During the semester I traveled several times to teach. The students interviewed domestic workers. Drafted law. Drafted a conjurer. This is again very important as I Learned from David in clinic education is about knowledge skills and values. So we tried to interview legislation, drafting legislation as one of the skills. And they have to compete. Especially in our courses we do not teach anything on drafting. I went to law school, I taught in law school but we never teach the students drafting context, mediation, drafting legislation so law clinic in here improving the legal curriculum and adding to it, adding something new. Hopefully, we will submit the modern law to the ILO. I like international organizations and I do it over that all the time. 3 years ago, I went to United Arab Emirates University and David was with me. And we drafted a modern law on the rights of the elderly. 95 and above. Yes. It is David and I had nothing to do with the elderly. It’s okay because in the united states of law people don’t die. Still too long. The rights of the elderly, and then I sent it to human rights council in the United Nations. Guess what? The United Nations is now in the process of drafting a convention on the rights of the elderly. Amazing. And then said come over, bring your students over, we would like to take a look at the modern law. We had 2 modern laws one in Arabic, one in English. And I was so happy that the clinic that extended clinic to a whole. I did the same thing with Alexendrea’s clinic. We drafted a modern law on the establishment and aggravation of anchors. As you know the government don’t like anchors other than Turkey of course. Turkey is an exception. But all over the world the governments do not like us. I am an anchor myself. So we drafted a modern law. This modern law is influencing the process of the anchor that was being submitted by the new Egyptian government. Perhaps, also from the podium, to the president of Egypt. Good luck. He is having a hard time. So that was the first model that I was very proud of. Last week I was in Sultan Kabus for a competition. Not a person competition. And the winner was Sultan Kabus University. I invited students from the few universities, and we came together with 30 or so. We showed us the modern law of those who are from the clinic from Sultan Kabus University. And they promised me, when I moved from the program they will have the clinic as equals. The second model is very dear to my heart because it is from my own country. I am Egyptian. Maybe, all of you figured that out from my accent. Yeah, I speak English with an Egyptian accent. In Egypt we have another model. We combine the service model with the project model; it was distinct models in one project. The topic is not domestic worker but something similar. It would be on human traffic, traffic of human beings in a very important issue in Asia. In Egypt we established the first clinic in 2009. And guess what? We did this with in corporations with the ministry of justice. So we established the clinic in Egypt. We cannot do without the government because we have to move it up with the government to establish a clinic. You know in the Arab world, especially before the Arab spring, clinics in the mind of state security are basically human rights project and state security and government don’t like too much, human rights. People don’t. So we have to bring the ministry of justice, and guess what, the ministry of justice told me if I am going to be a part of the project, number 1 no anchors. No civil society. I said what and we are establishing a clinic without such a thing. This will give you some idea about how government thinks. And we started the clinic in 2009. David helped me, was part of every training that I did. Now we have 8 clinics. In Asia we have 13 law schools. So 5 to go. So the project that I have in my mind was 1-8-13. That is the title of my project. 1-8-13. İnşallah in a year or so we will have a clinic in every law school in Egypt. What did we do? We brought the 8 clinics together and here is the project. Human traffic in Egypt takes different forms. Number one, prostitution. Yes. Sometimes it’s, you know, law doesn’t call it prostitution, they call it sexual act trying to be polite. So one of the clinics out of the 8 will cover prostitution. The second will cover begging. If you visited Egypt, they won’t leave you alone. They love begging. And we have too many street children, maybe over a million. And we have Egyptians working abroad because they leave Egypt, they go to Saudi, we have to do something about that. And then we have child labor. Nice cotton shirt that I am wearing. I am not sure whether it’s been used for child labor. And then we have early marriages. We have people of the gulf coming to Egypt 70 and 80 years old and they want to marry someone who is 15 or 16. Early marriage. And we have human donors. People are so poor. You go to Egypt and buy a kidney for 5000 Egyptian pounds. 800 dollars or so. So idea David wants to give in the clinic, a part of issue of the human traffic. And then we are going to all come together, provided that number one you have to interview. You have to provide services for the victim of human trafficking. So we can satisfy the service model. Number two, you are going to write a report on the cause of the problem, human organs for example, so you can satisfy the project model. And then number three, you go and raise awareness so we do it legally. We wanted to investigate law. So that is the model, that we combine and the service model, the project model and investigate law model. Let me conclude. Yeah very short because they told me I can talk for 20 minutes. I said good because sometimes they invite me and they have 5 minutes. So I travel for 24 hours and I have 5 minutes to speak but the Turkish people are generous. Yeah, I love Turkish people. They told me 20 minutes and I said Thanks God. So I am going to conclude with what I am doing in the United States, and try (5 more minutes excellent). So I am going to conclude in 5 minutes by talking about what I do in the United States, how I can get corporation with you. The dean of this lovely university. I was talking with Lena last night and I said, I wish our universities in Zambria and Kaira looked like that. They don’t look like that at all. I don’t know why. We don’t put enough money in education. In the United States, I established the first law clinic. John Hopkins University school of Advanced International studies and everybody tell me that you don’t have a law school. Yeah, I have a law department. I have a law department and we established something called International Human Right Clinic. This last semester our project was, some of my students traveled to Philippines and some of them traveled to Kuwait to learn about how the Kuwaitis treat Pilipino workers in Kuwait. It was lovely. And I was there for both trips and my students would try to report and the report would be submitted to the international labor organization as a document so we tried to teach our students improving the skill of writing, documenting a problem and writing a report. Now I am thinking about next year. I have no ideas. We decided in the school, John Hopkins University school of Advanced International studies, to run the clinic for the full year. We discovered that writing report in a month or so do not make sense. So for this coming semester, we are going to start in September teaching something about the project and in January, my students will go and do the fact funding admission and then they are going to have a semester to write a report. So now from the podium to the dean, help me with the issue and help me with the program. I would like to do that in corporation with your university. So here’s the idea that I have in mind. Let’s think about a topic and then bring The US to Turkey. Find something as bad in Turkey. I don’t because everything here is good accept maybe for this last year. They told me to be careful. I actually got e-mails be careful and you know. Aside from that everything is good. Let’s establish that our students in corporation with your students if we establish a clinic this semester. My students and your students can work together. Your students can come to the Unites States, and my students can come to Turkey. And then we can meet together by the end of the semester, and we have a report on an issue, which I did not really think about until now. I have a minute and the minute have to be devoted to. Yeah, thank you everybody. I am sure David put my name I am sure nobody knows about me but David said invite this guy so I want to thank David very much. I am prolonged at this. Something that I started in the Arab world and every time I go professors are taught in fresh style and difficult for them to understand that you can add a clinic and clinics makes sense but I am really proud of the fact that now we have clinics all over. Every year we have a regional conference. David hosted us for it. Last year, we had the conference in Qatar. Maybe the third conference we will do it in Turkey. How about that? So the third year I’ll make an announcement. Here’s the news. Third regional conferences on clinical legal education in the Middle East will be held here in Turkey. Thank you for having me.

[Mohamed Mattar: Kimsenin ayağa kalkmasını istemeyeceğime söz veriyorum. Bugün burada, bu güzel üniversitede ilk defa bulunuyor olmaktan ötürü çok mutluyum. Dolayısıyla da kürsüden Dekana selamlarımı ve tebriklerimi yolluyorum. Ama bu benim Türkiye’de ilk bulunuşum değil. Ben sürekli buradayım. Aslına bakılırsa Türkiye’de, Amerika’dan daha fazla zaman geçirdiğimi keşfettim. En azından karımın bana söylediği bu. Önümüzdeki hafta, 19 ve 20’sinde İstanbul’da kurumsal sosyal sorumluluk üzerine bir konferans düzenliyorum. Amerika’da, Beyrut Arap Üniversitesi’nde ve Kahire Üniversitesi’nde verdiğim bir ders bu aynı zamanda. Bu konferansa işletme eleştirisi üzerine bir oturum ekliyorum; Arap dünyasında teşvik etmek istediğim bir kavram. Bazen Arap dünyasında herhangi bir şeyi teşvik etmek zor ama deniyorum. Hukuk kliniği kavramıyla ilgili de aynı şeyi yaptım. David sayesinde. Arap dünyasında klinik eğitimin tarihi oldukça yeni. 8 yıl gibi bir şeyden bahsediyoruz. İlk hukuk kliniği Fas’ta 2005’te kuruldu. Şu anda Ürdün Üniversitesi dâhil Arap üniversitelerinin pek çoğunda hukuk kliniklerimiz mevcut. Profesör Lina Ürdün’deki klinikte yapmakta olduğu güzel işlerden bahsedecektir eminim. Ve yaklaşık 20 dakika boyunca uygulamakta bulunduğum ve gurur duyduğum 2 klinik eğitim modelini sizlerle paylaşmak istiyorum.

İlki Yasama Projesi Modeli adını verdiğim model. Geçen sene klinik eğitim üzerine her yıl yapılan bir konferans için İspanya’daydık ve orada Amerika’dan Profesör Elizabeth Cooper’dan bir konuşma dinledim. Kendisi kanun yapımını etkilemekten ve öğrencileri buna dâhil etmekten, ülkedeki yasama sürecine etki etmekten bahsetti. Ben de bu modeli Arap dünyasındaki bir takım hukuk kliniklerimizde uygulamaya karar verdim. Ve geçen sömestr ev işçilerinin hakları ile ilgili bir kanun tasarlanması üzerine bir proje gerçekleştirdim. Ev işçileriyle ilgili en güncel uluslararası konvansiyon Uluslararası Çalışma Örgütü ILO’nun Ev İşçileri için İnsana Yakışır İş Konvansiyonu. Dekan’ın da iş hukuku öğrettiğini öğrendim, ne kadar güzel çünkü ben de iş hukuku öğretiyorum. Dolayısıyla öğrencilerin ev işçilerinin haklarıyla ilgili modern bir yasa tasarısı üzerine çalışmaya başlamasını sağladık. Bu Arap dünyasında, özellikle de körfez bölgesinde çok önemli bir problem. Modeli pek çok nedenden ötürü beğeniyorum. Birincisi, bizim öğrencilerimiz için uygulamalı bir eğitimimiz yok. Dolayısıyla da öğrencilerimiz gidip mahkeme önüne çıkamıyorlar. Belki de burada proje modeli hizmet modelinden daha çok işe yarar. Üstelik bazı profesörlerimizin avukatlık yapma izinleri de yok. Örneğin Irak. Irak’ta kliniklerin kurulmasına yardım ettim, şu anda 5 tane kliniğimiz var. Irak’taki profesörlerin avukatlık yapma izinleri yok. Ya profesör olup hukuk öğretiyorsunuz ya da avukat olup avukatlık yapıyorsunuz. Modeli sevmemin nedenlerinden biri de hizmet proje modelini uygulayarak birden fazla kliniği birlikte çalışmaları için bir araya getirebiliyorsunuz. Ben de bunu yaptım. 3 yolculuk yaptım ve David bilir, ben seyahat etmeyi çok severim. Aslına bakılırsa her hafta seyahat ediyorum, istisnasız. Dolayısıyla Oman’daki Sultan Qaboos Üniversitesine, sonra Katar’daki Katar Üniversitesi’ne ve sonra da Kuveyt’teki Kuveyt Uluslararası Hukuk Okulu’na gittim. Ve üçü ilk kez bir klinik açmak konusunda anlaştılar. İlk kez. Klinikleri yoktu. Katar Üniversitesi’nin Dekanı nezaket göstererek bunu 3 kredi yaptı. “Sizi seviyorum” dedim. Böylece Kuveyt’e gittim ve onlar sadece 2 kredi yapacaklarını söylediler. “Sizi de seviyorum” dedim. Ve sonra Oman’a gittim ve onlar bunu kredili olarak değil bir program olarak yapacaklarını söylediler. İşte bunlar Arap dünyasındaki 2 modelimiz. Ya kredili bir ders ya da kredili olmayan bir program olarak 2 modelimiz var.

Sömestr boyunca ders vermek için birkaç kez seyahat ettim. Öğrenciler ev işçileriyle görüştüler. Yasa tasarladılar. İçerik hazırladılar. Bu çok önemli. David’den öğrendiğim gibi klinik eğitim bilgi, beceri ve değerlerle ilgili bir şey. Dolayısıyla da yasa tasarısı hazırlamayı becerilerden biri haline getirmeye çalışıyoruz. Derslerimizde tasarı hazırlama üzerine hiçbir şey öğretmiyoruz. Ben hukuk fakültesine gittim, hukuk fakültesinde ders verdim. Biz öğrencilere içerik tasarlamayı, müzakereyi, arabuluculuğu, yasa tasarısı hazırlamayı hiç öğretmiyoruz. Dolayısıyla da hukuk kliniği hukuk müfredatını geliştirmek ve ona bir şeyler katmak açısından önemli. Umuyorum ki modern yasayı ILO’ya sunacağız. Uluslararası örgütleri seviyorum ve her zaman onlar üzerinden yapıyorum. 2 yıl önce Birleşik Arap Emirlikleri Üniversitesi’ne gittim, David de benimleydi ve ileri yaşlı insanların hakları ile ilgili modern bir yasa tasarısı hazırladık. 95 ve üzeri. Sonra bunu Birleşmiş Milletler İnsan Hakları Konseyi’ne gönderdim. Bilin bakalım ne oldu? “Sayın Profesör Mattar, Birleşmiş Milletler şu anda ileri yaşlı insanların haklarıyla ilgili bir konvansiyon hazırlama sürecinde” diyen bir e-mail aldım. Harika. Ayrıca “Gelin, öğrencilerinizi de getirin, modern yasaya bir göz atmak istiyoruz” dediler. Biri Arapça biri İngilizce olmak üzere iki modern yasamız vardı. Ve klinik bunda, bu çapta bir rol oynadığı için çok mutlu oldum. Aynı şeyi İskenderiye Üniversitesi Hukuk Kliniği’nde de yaptım. STK’ların, sivil toplum kuruluşlarının kurulması ve çalışması hakkında modern bir yasa tasarladık. Bildiğiniz gibi hükümetler STK’ları sevmez, Türkiye hariç tabii. Türkiye bir istisna. Ama dünyanın hiç bir yerinde hükümetler bizi sevmez. Ben de bir STK’yım aslında, Johns Hopkins Üniversitesi’nin bir parçası olma bağlamında. Dolayısıyla modern bir yasa tasarısı hazırladık ve bu modern yasa yeni Mısır hükümeti tarafından Şura Konseyi’ne sunulmakta olan STK yasası sürecini etkiliyor. Aynı zamanda kürsüden Mısır Başkanı’na bol şans diliyorum. Zor bir zaman geçiriyor. İşte çok gurur duyduğum birinci model bu. Geçen hafta bir yarışma için Sultan Qaboos’taydım ve kazanan Sultan Qaboos Üniversitesi oldu. Birkaç üniversiteden öğrencileri davet ettim ve yaklaşık 30 kişi bir araya geldik. Sultan Qaboos Üniversitesi’ndeki klinikten gelenlerin modern yasasını seçtik. Ve bana programdan kredili modele geçeceklerine ve kliniği bir ders haline getireceklerine dair söz verdiler.

İkinci model benim için çok önemli çünkü benim kendi ülkemden. Ben Mısırlıyım. Belki de hepiniz bunu benim aksanımdan anlamışsınızdır. Evet, İngilizceyi Mısır aksanıyla konuşuyorum. Mısır’da başka bir modelimiz var. Hizmet modelini proje modeliyle birleştiriyoruz. Farklı modeller bir projede buluşuyor. Konu ev işçileri değil ama benzer bir şey, insan ticaretiyle ilgili. İnsan ticareti Mısır’da çok önemli bir konu. 2010 yılında bununla ilgili yasayı çıkardık. Mısır’da ilk hukuk kliniğini 2009’da açtık. Bunu Adalet Bakanlığı ile işbirliği içinde yaptık. Hükümet olmadan yapamazdık çünkü bir klinik açmak için hükümetin onayına ihtiyacımız vardı. Biliyorsunuz Arap dünyasında, özellikle de Arap Baharı’ndan önce, devlet güvenliğinin kafasında klinikler temel olarak insan hakları projesiydi ve devlet güvenliği ve hükümetler insan haklarını çok fazla sevmezler. Dolayısıyla da Adalet Bakanlığı’nı işin içine dâhil etmemiz gerekiyordu ve bilin bakalım ne oldu? Adalet Bakanlığı bana “Eğer projenin bir parçası olacaksam, 1. kural STK olmayacak, sivil toplum olmayacak” dedi. Ben de “Ne diyorsunuz, kliniği STK olmadan mı açacağız?” dedim. “Evet, STK yok. Biz hükümetiz, siz de bir devlet üniversitesisiniz. Sizinle çalışabiliriz ama STK olmayacak” dediler. Bu size hükümetin nasıl düşündüğü ile ilgili bir fikir verecektir. Ve kliniği 2009 yılında açtık. David bana yardım etti, yaptığım her eğitimin bir parçasıydı. Mısır’da 13 tane hukuk fakültemiz ve hâlihazırda 8 kliniğimiz var. Dolayısıyla 5 tane daha açmamız gerekiyor. Benim aklımdaki proje 1-8-13. Bu benim projemin adı. 1-8-13. İnşallah yaklaşık bir yıl içinde Mısır’daki her hukuk fakültesinde bir kliniğimiz olacak.

Ne yaptık? 8 kliniği bir araya getirdik. Proje şu: Mısır’da insan ticareti farklı şekillerde karşımıza çıkabiliyor. İlk olarak fuhuş. Bazen Amerika’da buna fuhuş demiyorlar, kibar olmaya çalışarak ticari cinsel edim diyorlar. Dolayısıyla 8 kliniğimizden biri fuhuşu ele alacak. İkincisi dilenmeyi ele alacak. Eğer Mısır’ı ziyaret ederseniz sizi yalnız bırakmazlar. Dilenmeyi seviyorlar. Ve çok fazla sokak çocuğumuz var, belki de bir milyondan fazla. Bunun yanı sıra yurt dışında çalışan Mısırlılar var. Mısır’ı terk ediyorlar, Suudi Arabistan’a gidiyorlar. Bu konuda bir şey yapmamız lazım. Ve sonra çocuk işçiliği var. Üstümde güzel bir pamuklu gömlek var. Çocuk işçiliği kullanıldı mı bundan emin değilim. Ve sonra erken yaşta evlilikler var. Körfezden Mısır’a gelen ve 15-16 yaşında biriyle evlenmek isteyen 70-80 yaşında insanlar var. Erken yaşta evlilik. Sonra organlarını satan insanlar var. İnsanlar çok fakir. Mısır’a gidiyorsunuz ve 5000 Mısır pounduna bir böbrek alıyorsunuz. Yaklaşık 800 dolar. Dolayısıyla planımız her kliniğe insan ticareti meselesinin bir boyutunu vermek. Sonra hepimiz bir araya geleceğiz. Ama bundan önce insan ticareti kurbanlarıyla görüşmemiz, onlara hizmet sunmamız gerekiyor. Böylece hizmet modelini gerçekleştireceğiz. İkinci olarak sorunun boyutu ile ilgili bir rapor yazacağız, insan organları mesela. Böylece proje modelini gerçekleştireceğiz. Sonra üçüncü olarak gidip farkındalık yaratacağız. Böylece sokak hukuku modelini gerçekleştireceğiz. İşte model bu; hizmet modelini, proje modelini ve sokak hukuku modelini birleştirmek.

Konuşmamı bitireyim artık. Evet, çok kısa çünkü bana 20 dakika konuşabilirsin dediler. Ben de iyi dedim çünkü bazen beni davet ediyorlar ve 5 dakika veriyorlar. Dolayısıyla 24 saat yolculuk yapıyorum ve konuşmak için 5 dakikam oluyor. Ama Türkler cömert. Evet, Türkleri seviyorum. Bana 20 dakika dediler, ben de Allaha şükür dedim. Dolayısıyla Amerika’da yaptığım bir şeyi anlatarak ve bu güzel üniversitenin Dekanıyla nasıl işbirliği yapabileceğimizi tartışarak 5 dakika içinde bitireceğim. Dün gece Lina’yla konuşuyordum ve keşke Kahire’deki, İskenderiye’deki üniversitelerimiz de böyle olsa dedim. Hiç buraya benzemiyorlar. Neden bilmiyorum. Biz eğitime yeteri kadar para ayırmıyoruz. Amerika’da, Johns Hopkins Üniversitesi Uluslararası Çalışmalar Yüksekokulu’nda ilk hukuk kliniğini açtım. Herkes bana bir hukuk fakülteniz yok dedi. Evet, bir hukuk bölümüm var. Bir hukuk bölümüm var ve Uluslararası İnsan Hakları Kliniği adında bir yer kurduk. Geçen sömestr projemiz şuydu: öğrencilerimden bazıları Filipinler’e, bazıları da Kuveytlilerin Filipinli işçilere nasıl davrandığı hakkında bilgi edinmek üzere Kuveyt’e gitti. Çok güzeldi. Ve ben her iki seyahatte de oradaydım. Öğrencilerim bir rapor yazmaya çalışacak ve rapor Uluslararası Çalışma Örgütü’ne teslim edilecek. Bu yüzden öğrencilerimizin yazma, bir sorunu belgeleme ve rapor yazma becerilerini geliştirmeye çalıştık. Şu anda gelecek yılı düşünüyorum. Hiçbir fikrim yok. Okulda, Johns Hopkins Üniversitesi Uluslararası Çalışmalar Yüksekokulu’nda kliniği bütün yıl boyunca çalıştırmaya karar verdik. Raporu bir ayda ya da onun gibi bir sürede yazmanın bir anlamı olmadığını keşfettik. Dolayısıyla önümüzdeki sömestr Eylül ayında proje hakkında bir şeyler öğretmeye başlayacağız, Ocak’ta öğrencilerim gidip bilgi toplama işini yapacaklar ve sonra da rapor yazmak için bir sömestrleri olacak.

Dolayısıyla şimdi kürsüden dekana sesleniyorum, bana konuyla ilgili ve programla ilgili yardım edin. Bunu sizin üniversitenizle işbirliği içinde yapmak istiyorum. Şimdi benim aklımdaki fikir şu. Bir konu düşünelim. Türkiye’de kötü olan bir şey bulun. Ben bulamam çünkü burada her şey güzel, belki geçen yıl olanlar hariç. Bana dikkatli olmamı söylediler. Gerçekten de dikkatli ol gibi e-mailler aldım, bilirsiniz. Onun dışında her şey güzel. Ama kötü bir şey varsa ve eğer bu sömestr bir klinik kuracaksanız, gelin bizim öğrencilerimiz, sizin öğrencilerinizle işbirliği yapsın, birlikte çalışsın. Sizin öğrencileriniz Amerika’ya gelir. Benim öğrencilerim de Türkiye’ye gelir. Sonra sömestrin sonuna doğru hep beraber buluşuruz ve seçtiğimiz konuyla ilgili bir raporumuz olur.

Bir dakikam var ve o dakika herkese teşekkür etmeye adanmalı. Eminim ki adımı David buraya yazdı. Eminim ki kimse beni tanımıyordu ama David bu adamı davet edin dedi. O yüzden David’e çok teşekkür etmek istiyorum. Ben hukuk klinikleri taraftarıyım. Arap dünyasında başlattığım bir şey ve ne zaman gitsem profesörlerin kliniklerin bir anlam ifade ettiğini anlamasının kolay olmadığını fark ediyorum. Ama şu anda her yerde kliniklerin olmasından ötürü gerçekten gururluyum. Her yıl bir bölgesel konferans yapıyoruz. Lina bunun için bize ev sahipliği yaptı. Geçen yıl da konferans Katar’daydı. Belki de üçüncü konferansı Türkiye’de yaparız. Ne dersiniz? Dolayısıyla üçüncü yıl için bir duyuru yapıyorum.
